When people hear that a book was challenged in a school library, they usually picture one of two endings: the book gets pulled, or the book stays. Pulled is the headline. Stays sounds like nothing happened at all.
I’m a high school librarian in Virginia, and I can tell you that “stays” is rarely that simple. Whether the book sits on the shelf during the review, who gets the final say, whether some students can still be blocked from reading it, and how soon someone can challenge it again all depend on where that library is located.
To see how much it varies, I read the challenge policies of three Virginia school districts: Henrico, a suburb of Richmond; Hanover, a rural county; and Fairfax, the most populous county in the Commonwealth. I also looked at the challenge policies of districts in Texas and Washington to get a better scope of the United States as a whole. I checked the Texas state law that every Texas district has to follow, and the procedure for Bellevue, Washington, a district just outside Seattle. Here’s what “challenged but not removed” can actually mean.

On the Shelf or Off?
The first thing that changes from place to place is what happens to the book while the review is underway, and that can be the difference between weeks and months without access.
In Texas, the answer is set by state law. Once a district receives a written challenge to a library book, it has to stop students from accessing that book until the school board takes action. If the district has a school library advisory council, the council gets up to 90 days to make a recommendation, and the board votes at its first open meeting after that. A book that is ultimately kept can still spend three months or more out of students’ hands.
Fairfax County goes the other way. Under its current regulation, which took effect in June 2023, a challenged library book will “remain available to students through regular library circulation methods throughout the review process.” It comes off the shelf only if the final decision says it should.
Hanover County lands in between. A challenged book stays in circulation during the review, unless the challenge claims it contains sexually explicit content as defined by Virginia law. In that case, if two staff members agree the definition is met, the book is pulled until the challenge is resolved.
Henrico’s policy and Bellevue’s procedure don’t address the question at all, which leaves it up to whoever is handling the challenge.
Who Gets the Final Word?
Who decides a book’s fate matters just as much to a challenge, because it shapes how much a single complaint can set in motion.
In Henrico County, challenges go to an Instructional Materials Review Committee chaired by the division’s library services specialist. It includes administrators, teachers, school librarians, at least one parent, and a School Board representative. Members read the whole book and judge it “as a whole and not in part”. The committee sends a recommendation to the superintendent, and the School Board makes the call.
Hanover County builds in more steps. A committee at the school reviews the challenge first. The person who filed it can appeal to a division-level Library Materials Committee, then to the School Board, whose decision is final.
Fairfax County leans on randomly selected committees. For a high school book, the committee includes two librarians, two parents, a school administrator, a member of the equity and family engagement team, and two high school students. They decide by blind vote. An assistant superintendent makes the decision. An appeal can go to the superintendent. The School Board takes up a full review only if at least three board members, after reading the book themselves, agree it deserves one.
Bellevue keeps the decision close to the library. The principal reviews the book with a teacher-librarian. Either the parent or the teacher-librarian can appeal to the superintendent, whose decision is final, and the school board isn’t part of the process. Bellevue’s procedure also requires those decisions to comply with a 2024 Washington law that bars school boards from rejecting materials because they include people from protected groups.
In Texas, the school board decides in an open meeting, after hearing from its library advisory council, if the district has one.
Kept, but With Conditions
This is where “retained” gets slippery. In several places, a book can survive a challenge and still be out of reach for some students.
Hanover County’s committees have a third option beyond removing or keeping a book: they can “modify the scope” of how it’s used. Hanover parents can also restrict their own child’s checkouts at any time, and every family gets an annual notice explaining how.
Texas law gives parents a similar tool. Any parent can submit a list of library books their child isn’t allowed to check out. Districts with an online learning portal also have to send parents a record of every book their child checks out, including the title, author, genre, and return date.
Bellevue’s procedure allows a decision to apply “only to the student or students” whose parent filed the request. A book can stay on the shelf for everyone, except the one kid whose family objected.
Fairfax takes the opposite approach. Library decisions apply across the whole division, and school staff won’t restrict a book for an individual student. A parent who wants to keep their own child away from a book is expected to handle that themselves.
Henrico’s library challenge process doesn’t mention restrictions. Retained means retained.
How Long Until It Can Be Challenged Again?
A win in a challenge doesn’t last forever. Every policy I read includes a waiting period, and the length varies a lot.
Henrico and Hanover both lock in the decision for four years. After that, a retained book can be challenged all over again.
Fairfax and Bellevue set the wait at three years. Bellevue lets the superintendent make an exception if there’s a “significant change in circumstances”. Fairfax adds limits on the people filing, too. Each person can file only two challenges per school year, and can’t start a new one until the last one is decided. County residents who don’t have a child directly affected by the book are capped at 10 challenges a year across the whole division, and those challenges are reviewed only twice a year.
Texas has the shortest window and the most loosely worded one. If a board decides not to remove a book, it isn’t required to act on new challenges to that book for two years. That’s a protection the board can choose to use, not a rule that blocks a new challenge. A board could decide to take one up sooner.
What Happened to Gender Queer and Lawn Boy?
Fairfax County offers a real-world answer to the question in my title.
In September 2021, Maia Kobabe’s Gender Queer: A Memoir and Jonathan Evison’s Lawn Boy were challenged over claims of sexually explicit content and claims that they referenced pedophilia. Both books were pulled from Fairfax high school libraries while two review committees read them. Each committee included administrators, librarians, parents, and students.
Both committees unanimously recommended keeping the books. They also found that neither book depicts pedophilia. In November 2021, after about two months off the shelves, the assistant superintendent for instructional services accepted the recommendations, and both books went back into circulation.
That two-month gap is worth noticing, because under Fairfax’s current regulation, it wouldn’t happen. Since June 2023, challenged library books in Fairfax stay available throughout the review. As of October 2026, both Gender Queer and Lawn Boy are still on the shelves in Fairfax County high school libraries.
What “Retained” Really Means
A book that’s challenged but not removed may still have been off the shelf for months. It may now be blocked for some students by a parent’s list or headed back into review in as little as two years. Or it may have stayed put the whole time, and nothing changed for the students who wanted to read it. It all depends on the district.
For librarians, a retained book is a vote of confidence in how we build our collections. But the process itself still takes a toll: hours of committee work, public meetings, and the quiet pressure to think twice about the next book on the order list.
“Retained” is the word that ends up in the board minutes, but it’s never the whole story. Sometimes it means a book never left. Sometimes it means a book spent a semester in a back office before it came home. Either way, the student who reaches for it on the shelf deserves to know what it took to keep it there.
