South Africa Reinstates Police Chief Oct 19

SOUTH AFRICA · POLICING

President Cyril Ramaphosa has lifted the suspension of police chief General Fannie Masemola, ending an absence of nearly six months. Business Day and the Sowetan reported on Friday 16 October that Masemola will resume full duties on Monday 19 October.

For US readers, the decision matters because it returns a settled police chief to the service that protects South Africa’s cities, mines and ports. It also follows a prosecution that prosecutors themselves abandoned, which has become a test of how Ramaphosa handles the police.

Why Masemola Was Suspended in April

Masemola is the National Commissioner of the South African Police Service, known as SAPS, the national police force. On Thursday 23 April Ramaphosa placed him on precautionary suspension, a pause in duties that is not a punishment.

Ramaphosa said the step followed the police chief’s court appearance in Pretoria on charges under the Public Finance Management Act. He said the suspension would last until the case ended.

What the Tender Case Was About

Idac is the anti-corruption unit inside the National Prosecuting Authority. It charged Masemola on four counts over a police health-care tender given to Medicare24 Tshwane District, a company owned by businessman Vusimuzi “Cat” Matlala.

TimesLIVE reported that the National Prosecuting Authority, known as the NPA, values the contract at about R228 million (about US$14 million). It added that the wider procurement was about R360 million (about US$22 million).

How the Charges Fell Apart

In July the Madlanga Commission, a judicial inquiry into crime and corruption in policing, questioned Andrea Johnson, the former head of Idac. EWN reported that commissioners saw no proof of corruption by Masemola, while Johnson argued he took too long to cancel the tender.

On Tuesday 15 September National Director of Public Prosecutions Andy Mothibi instructed that the charges be withdrawn, Business Day reported. The Pretoria magistrate’s court formally withdrew them on Tuesday 22 September, after a review of the Idac case.

Why the Return Took Another Month

Withdrawing the charges did not end the suspension automatically, because only the President could lift it. In late September Ramaphosa told reporters at a church anniversary event in Alberton, near Johannesburg, that the matter was under consideration and asked for patience.

TimesLIVE reported that the police chief described the five months as painful and said he was ready to return if the President called. Business Day and the Sowetan reported that Ramaphosa has now welcomed him back to his full duties.

Who Ran the Police in the Meantime

Lieutenant-General Puleng Dimpane, previously the SAPS divisional commissioner for financial management, has served as acting National Commissioner since April. Ramaphosa described her in April as a woman with a reputation for professionalism and integrity.

Business Day reported that Ramaphosa has thanked her for serving with distinction in the interim. No role has been announced for her once the police chief returns.

What It Means for US Readers

US companies with mines, factories and offices in South Africa depend on a police service with a settled chain of command. A police chief who returns after a withdrawn case removes one source of uncertainty for security planning and for investors watching governance.

The case also shows how South Africa’s politics and police leadership interact when prosecutors and the President disagree. Day-to-day policing continues as before, since Dimpane’s interim leadership kept the service running.

What Is Not Known

Ramaphosa waited until 16 October, almost four weeks after the court dropped the charges, and gave no public reason for the timing. It is also unclear whether the Presidency will review the case further.

TimesLIVE reported that the NPA will make a panel report available for an inquiry into how the prosecution team handled the case. It is not yet known what that inquiry will conclude, or what happens to the case against the other accused.
