Brazil Court Clears Vorcaro Ads 12 Days Out

ELECTIONS · BRAZIL

Brazil’s electoral court ruled on Tuesday 13 October that Vorcaro ads, linking Flávio Bolsonaro to banker Daniel Vorcaro, are lawful. The ruling lands 12 days before the 25 October runoff between the conservative senator and President Lula.

For US readers, the case shows how Brazilian judges police campaign speech on American platforms such as Meta’s Instagram. It also keeps the Banco Master affair at the centre of a race that US investors watch closely.

The Superior Electoral Court (TSE) removed the original post in full, because it also tied Flávio directly to organised crime. Yet it said the images about Vorcaro rest on public facts and may be shared again on their own.

What the Court Decided

The case began with a complaint from Flávio’s conservative Liberal Party (PL) against two federal deputies from Lula’s left-wing Workers’ Party (PT). Lindbergh Farias of Rio de Janeiro and Rogério Correia of Minas Gerais had posted two pieces on Instagram in June, before the official campaign.

One post was a carousel of 12 images headed “Flávio Bolsonaro and relations with organised crime”. The other was a montage that cast Flávio as the “coach” of an organised crime team.

In June the case rapporteur, Minister André Mendonça, ordered both posts removed in a preliminary decision. He found they went beyond political criticism by tying Flávio to crime without a minimum factual basis.

On Tuesday, Minister Floriano de Azevedo Marques proposed separating images based on facts already reported from those alleging direct criminal ties. Lula appointed Floriano to the electoral court on the recommendation of Supreme Court Justice Alexandre de Moraes.

Mendonça adjusted his vote to include that distinction, and the other ministers followed him unanimously. The carousel stays offline as a whole, but the images judged lawful may be republished one by one.

Why the Vorcaro Ads Survived

Among the lawful images is one referring to a 2025 audio in which Flávio asks Vorcaro for money. CNN Brasil has reported that the talks concerned funding for “Dark Horse”, a film about his father, former President Jair Bolsonaro.

Vorcaro is the former controlling shareholder of Banco Master, a lender whose collapse is under investigation in Brasília. Appearing in such images does not establish wrongdoing, and the court made no finding on the underlying facts.

The court also cleared images about Adriano da Nóbrega, a militia member killed in 2020, and about two police officers accused of extortion. Flávio’s former office at the Rio de Janeiro state assembly had employed Nóbrega’s mother and sister.

Floriano said such images describe the candidate’s relations with facts from his past, such as the hiring of relatives. In his view, that makes them fair material for voters to weigh in the campaign.

The Vorcaro link has dogged the senator for weeks, as covered in Flávio Bolsonaro Texts Hint at Vorcaro Visit. Related coverage follows the bank’s fallout in Banco Master Liquidator Sues for 3 US Mansions.

What Stays Banned

Claims that Flávio belongs to organised crime remain prohibited, along with images tying him directly to gangs and militias. Those included Rio de Janeiro politicians TH Joias and Rodrigo Bacellar, accused of favouring the Comando Vermelho drug faction.

The same session struck down ads that called Lula a “protector” and “friend” of the PCC and Comando Vermelho gangs. The court’s president, Minister Kássio Nunes Marques, said original remarks may be replayed, but not framed to imply criminal ties.

Minister Dias Toffoli backed the removal but criticised splitting posts into lawful and unlawful parts. He warned that judges were turning into “carousel consultants” with only about ten days of campaigning left.

What It Means for US Readers

Brazil is Latin America’s largest economy, and the runoff will shape its policy on trade, oil and relations with Washington. Attack ads in the final days test how settled the race really is, which matters for Brazilian stocks and the real.

The ruling also concerns Meta, whose Instagram hosted the posts and must act on Brazilian takedown orders. Nunes Marques warned that the precedent gives every campaign a “blank cheque” to draw the same kind of associations.

Lawsuits at the court have surged, and Nunes Marques cited a figure of 217% against the same period of the last election. He called it “excessive judicialisation”, and ministers urged the campaigns to debate before voters instead.

What Is Not Known

It is not known whether Lula’s campaign will turn the Vorcaro ads into television spots before 25 October. The two deputies have not said whether they will repost the cleared images on their own.

It is also unclear how judges will apply the new distinction to pending complaints from both campaigns. Nunes Marques said the ruling sets a standard for election judges nationwide, so its reach may grow quickly.

What Prediction Markets Say

Polymarket bettors give Flávio Bolsonaro an 85% chance of winning the presidency and Lula 14.5%, as of 1:31 p.m. ET on 14 October. The Flávio contract slipped about 1.5 points over the previous day.

The main Brazil election market has drawn about US$181.6 million in bets, including about US$944,000 in the past 24 hours. These are real-money bets, not polls, and they can move quickly on court rulings or debates.

Why we show this: prediction markets turn real-money bets into a live probability that moves within minutes of the news, which is why investors, campaigns and newsrooms in the United States now follow them closely. We show them next to polls and official results, never instead of them.
