Argentina Asks Sea Tribunal to Halt Falklands Oil Work

LAW OF THE SEA · ARGENTINA

Argentina has asked a sea tribunal in Hamburg to halt Sea Lion, a Falklands oil project majority-owned by Navitas Petroleum. The International Tribunal for the Law of the Sea (ITLOS) confirmed on Tuesday 13 October that it had received the request.

The case matters beyond the South Atlantic because it tests whether a treaty court can freeze oil work in disputed waters. Britain is a NATO ally of the United States, and Argentina has been a major non-NATO ally of Washington since 1998.

The request followed the expiry of Argentina’s two-week deadline for Britain to stop Sea Lion work, the Tucumán daily La Gaceta reported. The deadline dates from 28 September, as set out in Falklands Oil: Argentina Gives the UK Two Weeks, Then Plans a Law of the Sea Case.

What Argentina Asked the Tribunal to Do

According to the tribunal’s press release, Argentina invoked article 290, paragraph 5, of the UN Convention on the Law of the Sea. That rule lets a party seek urgent measures in Hamburg while a separate arbitral tribunal is still being formed.

Argentina opened that arbitration under Annex VII of the convention by notifying Britain on 28 September. ITLOS can act only if the future arbitral panel would, prima facie, have jurisdiction and the urgency of the situation requires it.

Argentina asked for four measures in total. First, Britain should prevent the start or continuation of hydrocarbon exploitation by Sea Lion in the North Malvinas Basin.

Second, Britain should not use data from exploring the disputed waters against Argentine rights. Third, it should stop preventing Argentina from protecting the marine environment there, as articles 192 and 194 of the convention require.

Fourth, Britain should take no step that could aggravate the dispute, especially new permits on the disputed continental shelf. The tribunal said the date of the oral hearings will be announced shortly in a further press release.

The Office of the President said the aim is to preserve Argentina’s sovereign rights over its continental shelf, Radio Nacional reported. It said Britain authorised the activities “unilaterally and illegally” and that they aggravate a dispute recognised by the United Nations.

The Foreign Ministry under Pablo Quirno runs the case with the Treasury Attorney’s Office and international legal advisers, La Gaceta reported. The newspaper stressed that the request does not ask the tribunal to rule on sovereignty over the islands themselves.

Why Sea Lion Matters and Who Owns It

Rockhopper Exploration discovered the Sea Lion field in 2010 in licence PL032, according to the British company’s website. Rockhopper holds 35% of that licence, and La Gaceta reported that Israel’s Navitas Petroleum holds the remaining 65%.

La Gaceta put the field about 220 kilometres (137 miles) north of the islands. Company plans call for development drilling in 2027 and first commercial production in the first quarter of 2028, the paper said.

For Argentina, the project tests its claim to the seabed around the islands, which it treats as its own continental shelf. For Britain, Sea Lion is a lawful project, and it says the islanders have the right to develop their natural resources.

The British government’s statement on Tuesday put it plainly. “Decisions on economic development in the Falkland Islands are matters for the Falkland Islands Government and the companies involved,” it said.

How Britain Responded

A British government statement published at 15:07 London time on Tuesday did not mention the tribunal filing. Instead it announced protective measures under the Protection of Trading Interests legislation against Argentine rules targeting Falklands business.

The measures are meant to stop UK companies from being forced to comply with Argentine rules applied outside Argentina. London aims to bring the secondary legislation into force before the end of the year, the statement said.

Business and Trade Secretary Jonathan Reynolds said the government “will act where Argentina seeks to impede lawful UK commercial activity.” Foreign Secretary Ed Miliband called Argentine attempts to intimidate businesses “unacceptable” and said UK support for the islands is “steadfast.”

Argentina’s domestic Malvinas rules have been tightening for weeks, as set out in Argentina’s Falklands Bill Carries Sweeping Powers Over Money and Trade. Neither government’s step stops work at sea today, because the tribunal has not ruled and London’s new rules still need legislation.

What It Means for US Readers

For investors, the filing adds legal risk to Falklands oil but does not halt it, since no order exists yet. Any provisional measures the tribunal prescribes would be binding, and the convention requires the parties to comply promptly.

The United States has never ratified the Law of the Sea convention, so it is not a party to this procedure. Still, a ruling could shape how courts treat resource work in disputed seas, an issue that also touches US interests elsewhere.

The request concerns oil work, exploration data and permits. It does not ask for limits on shipping, flights or travel to the islands, so visitors face no change from the filing.

For President Javier Milei, a close US partner, the case moves the islands dispute into a courtroom rather than onto the sea. That keeps tension with Britain high, but it is a legal process with clear rules and a neutral bench.

What Is Not Known

The tribunal has not yet set a hearing date or said when it would rule. It also has not said whether it sees prima facie jurisdiction, the first hurdle any such request must clear.

Britain’s formal legal answer to the request is not yet public. The reaction of the Falkland Islands Government to the filing could not be confirmed.

It is not known whether Rockhopper and Navitas will change their 2027 drilling plan. Neither company’s response to the filing could be confirmed from their own statements.

What Prediction Markets Say

Polymarket gives a UK announcement transferring the Falklands to Argentina in 2026 about a 2% chance (13 October, 2:37 p.m. ET). Trading volume on the question is about US$25,000, and its price slipped about one percentage point over the past week.

These are bets on a political outcome, not polls, and trading on this question is thin. A single large bet can therefore move the price sharply.

Why we show this: prediction markets turn real-money bets into a live probability that moves within minutes of the news, which is why investors, campaigns and newsrooms in the United States now follow them closely. We show them next to polls and official results, never instead of them.

Frequently Asked Questions

What is the International Tribunal for the Law of the Sea?

It is an independent court set up under the UN Convention on the Law of the Sea and based in Hamburg, Germany. It hears disputes about the convention, including urgent requests for provisional measures.

What did Argentina ask the tribunal to do?

Argentina asked for four provisional measures: that Britain prevent hydrocarbon exploitation by Sea Lion, not use exploration data against Argentine rights, stop blocking Argentina’s marine-environment duties, and avoid new permits or other steps that aggravate the dispute.

Does the filing stop the Sea Lion project?

No. The request does not suspend the project automatically. The judges must first decide whether the future arbitral tribunal would have jurisdiction and whether the situation is urgent.

Will the tribunal decide who owns the Falkland Islands?

No. According to La Gaceta, Argentina is not asking the tribunal to settle sovereignty over the islands, only to act on maritime obligations it says Britain has breached.

How has Britain responded?

On 13 October the British government announced measures under its Protection of Trading Interests legislation to shield UK businesses from Argentine rules targeting Falklands activity. Its statement did not mention the tribunal filing.
