Muted Response by NATO to First-Ever Russian Drone Attack vs. Cargo Ship in Romanian Territory

Reaction to deadly military drone attacks by Russia against civilian cargo ships in the territorial waters of NATO member state Romania – a theoretical act of war – was cautious, with senior officials in Bucharest and Brussels on Thursday declaring it “unacceptable” and “deplorable,” but not invoking Atlantic Alliance collective defense articles against the Kremlin.

Romanian interim Defense Minister Radu Miruță , in comments published by the mainstream Digi24 news platform, said that there was “no certainty” that Russian drones had struck two tankers near the Romanian port town Sulima in the Danube Delta, and stated his office was coordinating with the Bulgarian Defense Ministry to send a joint letter of concern to NATO headquarters about the incidents.

According to Romanian and Ukrainian news reports military drones breached the NATO air frontier at about 3 a.m. on Oct. 14 to hit the Comoros-flagged oil tanker Yara well inside Romanian territorial waters. It had been anchored about 8-10 nautical miles (14.8-18.5 km, or 9.2-11.5 statute miles) from Sulima. A fire breaking out following the drone’s detonation was extiguished and the Yara’s crew of 17 abandoned ship without incident.

At approximately the same time a drone or drones attacked and set afire the San Marine-flagged tanker Wine Trader as she stood at anchor without cargo some 12-14 nautical miles (22.2-25.9 ķm, or 13.8-16.1 statute miles) to the south-east of Sulima. Five crew were rescued and seven thought lost amid difficult sea conditions.

Russian Drone Strike Kills 6, Injures 13 in Lutsk as Zelensky Urges G7 to Force Moscow to Stop

Six people were killed and 13 injured in Lutsk, including a child. In Rivne, five people were hurt, and rescuers pulled a woman from rubble.

Miruță said that Romanian air defenses had not seen those particular aircraft coming.

“On the radars of the Ministry of Defense and the Coast Guard, this drone was not seen coming towards the ship that suffered this fire, which is now extinguished. The ship (Wine Trader) is heading to the Port of Constanta, where checks will be made when it arrives. If it was a drone, the technical expertise should observe this and then this aspect will be certain,” Miruță said in part. “More checks will be made to confirm whether it was a drone, if it was something else.

“Drones have no business in Romanian airspace, whether they hit a ship or not. This should not be something we get used to, but it should be something we respond to diplomatically,” Miruță said.

By international convention an attack against civilian shipping in territorial waters of a sovereign state, if launched by another state, is a definable act of war. The internationally-recognized extent of a country’s territorial waters is 12 nautical miles, a standard used by NATO member states.

NATO’s Article 4 gives member states the right to consult and request assistance in case of a threat to its territorial integrity. Article 5 of the NATO stipulates that an armed attack against any NATO state constitutes an armed attack against all NATO members and could trigger the use by NATO of armed force in collective defense.

Romanian interim Foreign Minister Oana Țoi in comments on her personal X channel that Russia bears “full responsibility” for turning the Black Sea into a war zone and called its attacks against ships and sailors passing through those waters “a crime.” Toiu said her government’s stance was that discussions with NATO fellow members was the best way to prevent Russian attacks in the future.

“We are coordinating closely with our allies and partners. We will intensify our efforts to strengthen NATO’s collective capacity to respond effectively to such incidents and to strengthen its deterrence and defense posture,” Țoiu said. “We continue to call for a ceasefire in the Black Sea, to eliminate risks to civilian ships and to restore safe navigation on this essential maritime route for global food trade.”

Russia during the first two weeks of October has intensified its naval strike campaign against cargo shipping transiting the Black Sea economic exclusion zones (EEZ) of NATO member states Bulgaria and Romania.

Confirmed incidents include the sinking of a cargo ship (2 crew dead 11 rescued) off Romania’s coast on Oct. 5, the sinking to one merchant ship and heavy damage to a second off Bulgaria’s coast on Oct. 6 (at least 10 crew lost, 18 rescued, some injured), a cargo ship in Bulgarian EEZ waters hit by drones and abandoned on Oct. 12 (all 15 crew rescued) and a cargo ship sunk in Romanian EEZ waters the same night (5 crew rescued, at least 11 missing).

Overnight on Oct. 13-14, one night before the Sulima strikes, according to a Romani Defense Ministry statement, Russian drones entered Romanian airspace and overflew Sulima port.

NATO air defenses launched F-18 fighters that failed to intercept the reported two or three drone encroachers, which returned unharmed to Ukrainian airspace. In air battles over Ukraine, that same night, Ukrainian air defenses claimed successful intercept and destruction of 115 out of 128 Russian military drones.

Defense Minister Miruță, commenting on the Oct. 14-15 violation of Romanian airspace by Russian drones for the second night running, explained to Romanian taxpayers it’s not so easy to locate a hostile drone and destroy it.

“The Black Sea is twice the size of Romania. Expecting that everything that flies, at any point in the Black Sea, will be detected and intercepted is an unrealistic expectation,” the civilian head of Romania’s armed forces said. “There are very frequent situations in which we see these drones, we track them, some disappear from the radar. The radar image does not provide details about the reason why they disappeared. Maybe they ran out of fuel, maybe they entered an area where our radars can no longer see because of the distance. There are many possibilities.”

On the night Oct 14-15, in airspace over Ukraine, Ukrainian air defenses claimed successful interception and destruction of 536 out of 580 Russian military drones.Union leader Adrian Mihălcioiu, President of Romania’s Seafarer’s Union (Sindicatul Liber al Navigatorilor) in Thursday televised comments called on the government to review its rules of engagement and access procedures for civilian shipping. He said the Sulima strike marked the first time in the Russo-Ukraine War that Russian weaponry had hit a ship in Romanian territorial waters with loss of life and that Russian attack was intentional. The Romanian state and its allies should take action to give effective protection to mariners, he said.

NATO Secretary General Mark Rutte on Thursday held a meeting in Brussels with President Nicușor Dan and Bulgarian PM Radev about Black Sea security and Russian attacks on commercial shipping and maritime free trade. Rutte in subsequent comments to media said that NATO has already strengthened its eastern-flank posture and, “will continue to work closely with our Allies in the Black Sea, adjusting our deterrence and defence posture as needed.”

No activation of Article 4 was announced. Rutte’s official comment did not mention Russia by name.
