The US Securities and Exchange Commission (SEC) has added artificial intelligence (AI) superintelligence and tokenization to its fiscal 2027 examination priorities. The regulator's October 23 announcement identifies both technologies among areas requiring closer supervision as financial firms introduce new products and trading systems.
The SEC's examination priorities cover more than 34,000 registered firms, including investment advisers, broker-dealers, clearing agencies and transfer agents.
SEC Expands Superintelligence Oversight in Financial Markets
The SEC's Division of Examinations identified 'super intelligence and other advanced technologies' as an examination priority. Regulators will assess how financial institutions use advanced AI systems in trading, compliance, fraud prevention and customer services.
The agency said firms increasingly use these tools for investment analysis, customer management and software development. However, the regulator raised concerns about cybercriminals using the same technology to automate attacks.
According to the FY2027 examination report, examiners will review whether firms can respond to AI-generated phishing messages, fake voices and manipulated videos. They will examine whether automated investment tools provide advice consistent with investors' financial profiles.
SEC Adds Tokenization to its 2027 Market Infrastructure Reviews
The SEC identified tokenization among risks linked to changing financial market infrastructure. Tokenization allows companies to represent traditional securities through digital records, including blockchain-based systems.
Under the new examination priorities, regulators will review clearing agencies' controls for handling tokenized securities. These reviews will cover operational risks, recordkeeping, system reliability and compliance with existing securities regulations.
The agency will examine tokenization under Regulation Systems Compliance and Integrity, which governs technology systems used by certain exchanges and other market operators.
The review will cover extended trading hours, quantum computing and advanced technology alongside tokenized securities. Meanwhile, transfer agents will face examinations covering their use of emerging technology to maintain ownership records and process securities transfers.
SEC Maintains Crypto Oversight
The 2027 examination priorities do not establish a separate category for cryptocurrency businesses. This follows the SEC's decision to remove crypto from its standalone 2026 examination priorities.
However, tokenization now appears within the agency's review of market infrastructure. The SEC has separately been developing rules and guidance for blockchain-based securities, including a proposed overhaul of transfer agent requirements.
The new priorities do not create additional regulations or automatically classify tokenized assets as securities. Instead, they guide examiners when assessing whether registered firms comply with existing federal securities laws.
What Happens Next for SEC AI and Tokenization Reviews
SEC Division of Examinations Director Keith Cassidy said the regulator must adjust its supervision as financial markets change.
'The markets we oversee continue to evolve rapidly, and the examination program must evolve with them,' Cassidy said.
SEC Chairman Paul Atkins said examinations help the agency identify developing risks and assess how firms comply with securities laws.
The division said its examination priorities are not exhaustive. Regulators may review other activities and adjust their focus throughout fiscal 2027 as new market risks emerge.
The SEC has scheduled a November 9 roundtable on machine-understandable financial data and superintelligence. The meeting will examine how market participants use advanced technology and the associated risks and costs.
