An Australian homeowner’s long-running dispute over invasive bamboo has ended with a court order for coordinated removal and a payment of A$6,253.50 toward treatment and likely repairs.
In Wines v Homes NSW, the Land and Environment Court of New South Wales found that bamboo growing principally on a neighbouring property had spread beneath the boundary fence, previously blocked the homeowner’s terracotta sewer line, and was likely to cause further blockage and fence problems. Case Law Wire reports that Acting Commissioner Austin delivered the decision on September 29, 2026.The case is a useful reminder that garden plants can become a serious legal and financial issue when their roots cross property boundaries. While the court did not accept every claim made by the homeowner, it found enough evidence of actual and likely damage to order practical remedial action rather than leaving the problem to continue. What the homeowner alleged
Henry Wines and Homes NSW owned neighbouring properties on Rymill Road in Tregear, New South Wales.
Wines applied under Part 2 of the Trees (Disputes Between Neighbours) Act 2006 (NSW), alleging that running bamboo originating mainly on Homes NSW’s land had spread beneath the shared boundary fence and onto his property. He said the bamboo had blocked a terracotta sewer line in 2024, damaged or displaced his Colorbond fence, reduced his use of the backyard, and created a future risk to his dwelling. He asked the court for removal and eradication works, repairs, reimbursement, access arrangements, and payment of his filing fee.
The dispute centred on running bamboo, a plant known for spreading through underground rhizomes rather than staying neatly contained in one garden. Once established, it can travel beneath fences and reappear on neighbouring land, making removal difficult unless both sides address the root system.
What the court found
Acting Commissioner Austin granted the application in part. The court accepted that the bamboo had previously blocked Wines’ sewer pipe and was likely to cause further blockages in future.
It also found that regrowth was likely to place pressure on the fence and cause it to become misaligned. Those findings were enough to engage the court’s jurisdiction under section 10(2)(a) of the Act, which allows orders where a tree on neighbouring land has caused, or is likely soon to cause, damage to property. The decision shows that bamboo can be treated as a “tree” for the purposes of the legislation when it creates a qualifying risk. However, the court did not find that the visible dents in the fence had been caused by the bamboo. It also rejected the claim that structural damage to the dwelling was likely in the near future, and it held that reduced enjoyment of the backyard was not “damage to property” under the limited statutory framework.
Why the A$3,500 plumbing claim failed
One of the more significant parts of the ruling involved Wines’ request for A$3,500 to reimburse plumbing work carried out in 2024.
The court refused that claim because Homes NSW had not been notified of the problem until April 2026. The court also found that Homes NSW had not contributed to the pipe damage or degradation through an act or omission. Thus, the court found that bamboo had blocked the sewer, but the neighbor could not be held liable for costs incurred years earlier because of the lack of timely notice. This section of the decision is about early recording of plant damage.
Homeowners who discover roots, blockages, fence movement, or other boundary issues may strengthen their position by notifying the neighbouring owner promptly, keeping invoices and photographs, and seeking expert advice before carrying out major repairs.
Staged removal and coordinated treatment
Rather than ordering a single quick fix, the court approved a staged treatment and removal plan. Homes NSW was ordered to provide contractor details and begin specified works within 60 days of the decision.
Wines was required to engage the contractor for coordinated treatment on his own property. That cooperative approach reflects the practical reality of bamboo removal: if the underground root system remains active on either side of the fence, regrowth can continue and the problem may return.
The court did not require the root-barrier proposal that had been suggested. Instead, it focused on a staged programme capable of treating the bamboo across both properties over an extended period.
The A$6,253.50 payment
Homes NSW was ordered to pay A$6,253.50 within 28 days. The payment is for previous bamboo treatment costs, and likely remedial costs, due to the situation. That was less than the full compensation Wines was seeking, but a significant contribution to the problem nonetheless. The court’s approach balanced the proven risk of future damage against the limits of what could be established about past losses. The ruling also makes clear that a court may order forward-looking action even where not every alleged past consequence has been proved.
Preventing recurring sewer blockages and fence displacement was treated as a practical priority.
Why this case matters
The decision illustrates how narrowly neighbour-tree laws can operate in New South Wales. A homeowner cannot rely only on inconvenience or reduced enjoyment of their garden; they must show actual property damage or a qualifying likelihood of damage in the near future. At the same time, the case confirms that invasive bamboo can support a legal claim when it causes or threatens concrete harm.
Evidence of pipe blockage and likely fence displacement was sufficient, even though some other allegations were not accepted.
For homeowners, the case is a warning to take fast-spreading plants seriously. Bamboo may look attractive as a privacy screen, but running varieties can spread underground, damage drainage systems, and create expensive disputes between neighbours.
A practical lesson for neighbours
The court’s order for coordinated treatment recognises that boundary disputes often require cooperation rather than blame alone.
Because bamboo roots do not respect fences, successful removal may depend on both property owners allowing access and treating the plant at the same time. The case also shows why early communication matters. Had Homes NSW been aware of the sewer blockage in 2024 sooner, the outcome of reimbursement may have been different. Timely notice gives the other party an opportunity to inspect the issue, obtain advice, and respond before costs escalate. The answer is for anybody with a similar problem to keep records, get a professional assessment and seek a remedy that is focused on preventing further damage. In this case, the court chose a staged and coordinated solution designed to stop the bamboo from returning and causing new harm.
