According to the charge sheet seen by TUKO.co.ke, on July 15 and 16, at an unknown place within the Republic of Kenya, with intent to defraud, they falsely represented themselves to be persons employed by Sunking/Green Planet Kenya Limited in the capacity of salespersons, jointly with others who were not present in court.
Donna Moraa Omanwa faces an alternative charge of possession of proceeds of crime, contrary to Section 4(c), as read with Section 16(1)(a) of the Proceeds of Crime and Anti-Money Laundering Act No. 9 of 2009.
The particulars state that on 16th July 2026, at an unknown place within the Republic of Kenya, she knowingly received KSh 1,000 in her Choice Microfinance Bank account number 02**6, from Safaricom M-Pesa number in the name of Newton Koli, domiciled at Safaricom PLC, whilst knowing or reasonably ought to have known that the sum formed part of or was proceeds of crime.
It is also alleged that on July 16, she transacted KSh1,000 from her Choice Microfinance Bank account.
The other accused, Clinton Maloba Anzoka, also faces charges of acquisition of proceeds of crime, contrary to Section 4(a), as read with Section 16(1)(a) of the Proceeds of Crime and Anti-Money Laundering Act No. 9 of 2009.
On July 15, Maloba is said to have acquired KSh550 from Safaricom M-Pesa number in the name of Newton Koli, domiciled at Safaricom PLC, to his Choice Microfinance Bank account number in the name of Clinton Maloba Anzoka.
However, the defence asked the court to grant them lenient bail terms stating that the offences they face are misdemeanors.
In her ruling, the presiding magistrate granted each of them a bond of KSh50,000 or an alternative cash bail of KSh30,000. The matter is set for pre-trial on November 9.
