Prosekusyon, hiniling sa ICC na isama ang mga naunang testimonya ng 5 saksi sa kaso ni Rodrigo Duterte

Hiniling ng prosekusyon sa kaso ng dating pangulong Rodrigo Duterte noong Biyernes sa International Criminal Court (ICC) Trial Chamber III na payagan ang mga naunang naitalang testimonya ng limang saksi bilang ebidensya.

Sa isang 12-pahinang dokumento, kung saan pinost ang isang redacted version sa website ng ICC, hiniling ni ICC Acting Prosecutor Mame Mandiaye Niang na payagan silang magsumite ng mga transcript at kaugnay na materyal ng mga saksing sina P-1087, P-1151, P-1158, P-1161, at P-1204 (tinutukoy bilang Five Witnesses).

"Granting the request will enhance the expeditiousness of the proceedings by reducing the length of the witnesses’ direct examination from [REDACTED] hours to [REDACTED] hours, thus saving at least [REDACTED] hours of court time," sabi ni Niang.

“Relevant,” “reliable,” at “probative,” ang mga naunang naitalang testimonya ng Five Witnesses, dagdag niya.

"As [REDACTED], the Five Witnesses provide evidence on [REDACTED]. As such, their evidence is particularly relevant to the policy to ‘neutralise’ through violent crimes, including murder, alleged criminals in the Philippines and to [REDACTED] to implement this policy," sabi ni Niang.

"The introduction into evidence of the Prior Recorded Testimonies is not prejudicial to or inconsistent with the rights of the Accused, as the Five Witnesses will be available for cross examination by the Defence and any further questioning by the Chamber, the parties, and the Common Legal Representatives of Victims (the “CLRV”)," dagdag niya.

Overview

Nagbigay ang Prosekusyon ng pangkalahatang-ideya ng mga testimonya ng Five Witnesses.

Inilarawan ni P-1087 sa kaniyang dalawang araw na panayam, "how killings were normalised [REDACTED] during Mr Duterte’s presidency. Specifically, he notes that the President Rodrigo Roa Duterte list ('PRRD list') list provided officers with a feeling of impunity11 and that Mr Duterte’s speeches contributed to a culture in which killing was normalised."

Inilarawan ni P-1151 ang "killings perpetrated by the PNP", ang Operation Double Barrel, at ang listahan ni PRRD. Tinalakay din ng saksi ang sistema ng gantimpala para sa mga pulis na sangkot sa mga pagpatay.

Nagbigay din si P-1158 ng patunay sa patakarang "neutralize" ang mga umano'y kriminal sa Pilipinas at sa indibidwal na kriminal na responsibilidad ni Duterte.

Tinalakay sa P-1161 ang pagkakasangkot ni Duterte sa listahan ni PRRD.

Samantala, inilarawan ng P-1204 ang mga pagbabago sa loob ng PNP matapos maging pangulo si Duterte.

Nahaharap si Duterte sa mga kasong krimen laban sa sangkatauhan kaugnay ng mga extrajudicial killings umano'y sa giyera kontra droga noong kaniyang termino bilang pangulo, at noong kaniyang termino bilang alkalde ng Davao City.

Inaresto siya noong Marso 2025 sa Ninoy Aquino International Airport Terminal 3 at kasalukuyang nakakulong sa ICC Detention Centre sa Scheveningen sa The Hague, The Netherlands.

Magsisimula ang paglilitis kay Duterte sa Nobyembre 30.
