The Islamabad High Court (IHC) on Friday imposed a fine of Rs200,000 on Advocate Siraj Ahmed for wasting the court’s time by filing a frivolous and meritless petition, reported 24NewsHD TV channel.
Justice Khadim Hussain Soomro imposed the fine and directed the petitioner to deposit Rs200,000 into the national exchequer.
The court further ordered that, until the fine is deposited, the petitioner shall not be permitted to enter the administrative or judicial branches of the High Court.
The court clarified that the petitioner will, however, be allowed to enter the court premises for the specific purpose of appearing in cases scheduled for a hearing.
The court noted that the petitioner failed to provide any satisfactory arguments to address objections raised regarding the maintainability of the petition. According to the judicial order, the petitioner also failed to establish that the matter is already pending before ‘Bench I’ of the High Court.
The court observed that the petition was drafted in an extremely frivolous manner, failing to meet the standards required for legal drafting and judicial procedure.
The lawyer’s conduct was not appropriate, neither during the preparation of the application nor during the court appearance, the court remarked.
The court noted that it had previously exercised restraint regarding similar conduct by the same lawyer in another case, and observed that the petitioner has consistently demonstrated a frivolous attitude in the preparation of petitions and the presentation of arguments in his own personal cases.
Directions have been issued to send a copy of the judicial order to the Islamabad High Court Bar Association, the Islamabad Bar Council, and the District Bar Association.
