The National Directorate-General for Aliens Policing published the rules on its official website, identifying the residence permit types that prevent third-country nationals people who are not citizens of Hungary or another European Union member state from bringing relatives to live with them through family reunification.
The restrictions apply in 2026 and are particularly relevant to foreign workers, international students and other non-EU nationals planning to relocate to Hungary with their families.
Hungary lists nine categories of foreigners barred from family reunification
According to the immigration authority, a family reunification residence permit cannot be issued to the relatives of a foreign national who falls into any of the following categories:

- Guest self-employment permit holders: Foreigners who do not hold a residence permit for guest self-employment valid for at least one year.
- Seasonal workers: Those holding residence permits for seasonal employment.
- Investment-related employment permit holders: Foreigners with residence permits for employment for the purpose of investment.
- Employment permit holders: Those holding residence permits for employment.
- Guest workers: Foreign nationals with residence permits specifically issued for guest-worker employment.
- White Card holders: Foreigners holding Hungary’s White Card, a residence permit associated with remote work.
- Students and trainees in education: Those holding residence permits for studies, including permits for seeking employment or starting a business after studies, as well as permits for training.
- Traineeship permit holders: Foreign nationals residing in Hungary under a traineeship residence permit.
- Voluntary service permit holders: Those with residence permits issued for voluntary service.
The list means that having legal permission to reside or work in Hungary does not automatically give a foreign national the right to sponsor relatives for family reunification.
Hungary introduces an additional rule for spouses
The immigration authority has also clarified a restriction involving spouses.
A spouse cannot be granted a family reunification residence permit if the sponsor’s other spouse already holds a residence visa or residence permit issued on the same grounds.
This provision adds another condition for applicants to consider when assessing whether their family members qualify to join them in Hungary.
What the rules mean for foreigners planning to move to Hungary
The guidance highlights the importance of checking the specific type of residence permit held by a foreign national before making plans to relocate family members.
Some permit categories, including those associated with seasonal work, guest employment, studies, traineeships and voluntary service, do not qualify their holders to sponsor relatives under the stated family reunification rules.
The guidance identifies a guest self-employment residence permit valid for at least one year as an important distinction. However, foreigners should confirm their eligibility under the full immigration requirements rather than assume that the duration of a permit alone guarantees approval.
Foreign nationals planning to move to Hungary with a spouse or children should consult the National Directorate-General for Aliens Policing’s official guidance to verify their permit category and any applicable conditions before making travel or relocation arrangements.
