An Arizona man who was duct-taped to his seat during a scuffle aboard an American Airlines flight has been federally indicted on charges carrying a potential sentence of up to 20 years in prison.
The indictment marks a major development in a case that drew national attention after fellow passengers restrained him during the flight from Dallas, Texas, to Newark, New Jersey. Arthur "Layne" Lundeen, 67, now faces federal charges that he assaulted a passenger and interfered with flight crew members, while prosecutors say his behavior forced an emergency landing in Baltimore.
The charges announced by the U.S. Attorney's Office for the District of Maryland stem from a September 3 incident aboard American Airlines Flight 618. Prosecutors allege Lundeen intimidated crew members, ignored instructions from flight attendants, directed racial slurs at airline staff and passengers, and engaged in hostile conduct that disrupted the flight.
Newsweek has reached out to Lundeen's attorney, Anatoly Smolkin, for comment.

Arizona Man Indicted in American Airlines Flight Disturbance
Federal prosecutors announced that Lundeen has been indicted on charges of interfering with flight crew members and attendants and assault by striking, beating and wounding. According to the indictment, he is charged with assaulting a passenger aboard the flight traveling from Dallas to Newark, prompting an unscheduled landing at Baltimore/Washington International Thurgood Marshall Airport.
Authorities allege Lundeen interfered with flight attendants attempting to perform their duties by intimidating crew members, disregarding instructions, making physical contact with airline personnel and directing abusive language toward crew and passengers. Prosecutors stressed that the indictment is an allegation and that Lundeen is presumed innocent unless proved guilty in court.
The federal case significantly raises the stakes compared with the state charges filed immediately after the incident. Maryland court records show Lundeen was previously charged with second-degree assault and disorderly conduct, both misdemeanors, following his arrest at BWI Airport.
A trial originally scheduled for October 19 was postponed. Court records show the case has been reset for November 16.
What Prosecutors Allege Happened on Flight 618
The incident occurred aboard American Airlines Flight 618, which was traveling from Dallas Fort Worth International Airport to Newark Liberty International Airport. Passengers said a disturbance erupted during the flight after Lundeen allegedly became increasingly belligerent.
Juan Mejia, passenger and former law enforcement officer, previously told CBS News that the disturbance escalated suddenly. He alleged that Lundeen placed his hands around the neck of another passenger and subjected people nearby to a stream of profane, racist and discriminatory comments.
As tensions mounted, fellow passengers stepped in. Mejia and another traveler, Richard Olenick, helped restrain Lundeen, who was ultimately secured to his first-class seat with duct tape and zip ties until the aircraft could land safely in Baltimore.
Photographs from the flight showing Lundeen restrained aboard the aircraft quickly spread online and turned the case into a national news story. After landing, law enforcement officers boarded the aircraft and removed him before the plane continued to Newark.
Lundeen Reportedly Said He Could Not Remember the Outburst
Weeks after the incident, reports from Lundeen's initial court appearance suggested he claimed to have little or no memory of what occurred aboard the flight.
According to audio cited by The Baltimore Banner, Lundeen told a court commissioner: "I don't remember any of what happened." During the hearing, he reportedly appeared confused as charges were read aloud and later expressed disbelief over the allegations.
Lundeen also acknowledged consuming alcohol before the flight, reportedly telling the court he had two screwdrivers before boarding. According to reports of the hearing, he later remarked, "Oh my God. What a mess," while maintaining that he could not remember the events that led to his arrest.
He has not publicly responded to the allegations in the indictment. His attorney previously declined to comment following his arrest.
Newsweek First Reported Real Estate Firm Dropped Lundeen
In the days following the incident, Newsweek first reported that Tucson-based Long Realty had severed its affiliation with Lundeen upon learning of the allegations.
At the time, the company confirmed Lundeen had been affiliated as a real estate agent but said he was no longer authorized to represent the firm in any capacity. Long Realty CEO Kevin Kaplan said the conduct described in reports was inconsistent with the company's standards and values.
"The conduct described in the reports is wholly inconsistent with the professionalism, integrity, compassion, and respect for others that Long Realty expects from those affiliated with the company," Kaplan told Newsweek.
The company added that its thoughts were with the passengers, crew members and others affected by the incident. The employment fallout came before any criminal case had been resolved, illustrating the wider professional consequences that can accompany highly publicized incidents aboard commercial flights.
Why Lundeen Could Face Up to 20 Years in Prison
The most serious charge filed against Lundeen is interfering with flight crew members and attendants. Federal law allows for a maximum sentence of 20 years in prison for conduct that intimidates or interferes with flight crew members carrying out their duties aboard an aircraft.
According to prosecutors, Lundeen's alleged actions disrupted airline personnel attempting to manage the situation and maintain safety aboard the flight. The assault charge included in the indictment carries a separate maximum penalty of one year in prison.
Actual sentences in federal cases are often lower than statutory maximums and determined by a judge after considering federal sentencing guidelines and other relevant factors.
The case also highlights the federal government's continued focus on airline safety. While reports of unruly passengers have declined significantly since pandemic-era highs, federal authorities continue to pursue criminal charges in cases involving alleged assaults, threats or interference with flight crews.
The Federal Aviation Administration has reported more than 1,160 unruly passenger incidents so far in 2026. Regulators warn that disruptive behavior can lead not only to criminal prosecution and substantial fines but also the loss of TSA PreCheck eligibility and airline travel privileges.
