SHILLONG, OCT 14: A day after Bar Associations withdrew their indefinite court boycott, the Meghalaya High Court on Wednesday accepted their unconditional apology and closed the suo motu contempt case.
The case, PIL No. 21/2026, was registered after the Shillong Bar Association and the High Court of Meghalaya Bar Association on September 30 called for abstention from judicial work in all districts from October 1 until the state government removed the Advocate General.
On October 8, a bench of Chief Justice Revati Mohite Dere and Justice HS Thangkhiew issued contempt notices under Section 15 of the Contempt of Courts Act to the office bearers of the Associations, returnable on October 13.
According to the order passed on October 14, all advocates except those at Sl. Nos. 13 and 15(vi) appeared on October 13 and tendered unconditional apology.
The court noted that the two who did not appear had resigned much prior to the boycott resolution, and proceedings against them were dropped as a matter of record.
Advocates KS Kynjing and N Syngkon at Sl. Nos. 1 and 2 filed affidavits with proof that they had not participated in the boycott and had appeared before courts. The court dropped contempt against them as well.
The remaining advocates at Sl. Nos. 3 to 8, 9 to 12, 14 and 15(i-v) filed affidavits with identical content, tendering unconditional apology, expressing sincere regret and assuring the court they would not participate in any such abstention in future. They also stated they hold the highest regard for rule of law and administration of justice.
The court noted that the Associations withdrew the boycott on October 9 itself, the very next day after contempt notices were issued.
“Considering the withdrawal at the earliest, unconditional apology tendered at the earliest opportunity and assurance given, this Court is of the view that the majesty of law stands restored,” the bench observed.
Accepting the apology, the court purged the contemnors of contempt, discharged them and closed the petition.
The bench also acknowledged and appreciated the stand taken by both Bar Associations.
